These Terms & Conditions (“Terms”) are a legal agreement between you and Atompod Integration LLC, doing business as FieldTechnicians.com (herein referred to as “Atompod”, “we”, “us”, or “our”), governing your access to and use of our website at fieldtechnicians.com, our field service provider (FSP) portal, and our mobile application (together, the “Services”).
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility & Independent Contractor Status
You must be at least 18 years old and legally able to work as an independent contractor to use the Services. You acknowledge that you (or the company you represent) are an independent contractor and not an employee, agent, partner, or joint venturer of Atompod. Nothing in these Terms creates an employment relationship. You are responsible for your own taxes, licenses, permits, insurance, tools, and business operations.
2. The Services
Atompod operates a marketplace and platform that connects field service technicians with businesses that need on-site work performed. We may present you with work order opportunities, facilitate scheduling and coordination, collect deliverables, and facilitate payment for completed work. We do not guarantee any minimum amount of work, offers, or earnings.
3. Communications Consent
By using the Services, you consent to receive communications from Atompod by email, phone call, and SMS/MMS text message regarding work order opportunities, work orders you accept, payment information, reminders, status updates, requests for deliverables and other information needed to complete and pay for work orders, and account and service notices. This consent, including how to opt out (reply STOP to texts), is described in detail in our Privacy Policy, which is incorporated into these Terms. This applies equally to the mobile app.
4. Work Orders, Offers & Performance
- Accepting an offer or work order creates a commitment to perform the work described, on the schedule and to the standards specified.
- You agree to arrive on time, communicate promptly, follow client and site requirements and safety procedures, and complete the work professionally.
- You agree to submit accurate check-ins, timesheets, notes, photos, signatures, and other deliverables required to document and close out the work. Payment for a work order may depend on your submission of the required deliverables and information.
- You are solely responsible for the quality and legality of the work you perform.
5. Payment
Payment for completed and approved work is facilitated through our third-party payment processor (Stripe, including Stripe Connect). Atompod does not collect or store your bank account or tax (W-9) information; that information is collected and stored directly by the payment processor under its own terms. To receive payment, you must complete the payment processor’s onboarding and provide the required banking and tax information to it. Payment is contingent on satisfactory completion of the work and submission of all required deliverables and information. Timing of payouts is subject to the payment processor and to work order close-out and approval.
6. Your Obligations
- Provide accurate, current, and complete information, including your profile, skills, availability, and identity (your profile photo must be of you and may be used to verify your identity).
- Maintain any licenses, certifications, permits, and insurance required for the work you perform.
- Keep your account credentials confidential and be responsible for activity under your account.
- Comply with all applicable laws and with client and site requirements.
7. Mobile App License
Subject to these Terms, Atompod grants you a limited, non-exclusive, non-transferable, revocable license to use the mobile app to access the Services. All provisions of these Terms and our Privacy Policy—including the communications consent in Section 3—apply to your use of the mobile app. You may not copy, modify, reverse engineer, or misuse the app.
8. Prohibited Conduct
- Providing false, misleading, or fraudulent information, or impersonating another person (including using a photo that is not of you).
- Circumventing the platform to solicit or divert clients or payments off-platform.
- Interfering with, disrupting, or attempting to gain unauthorized access to the Services or other users’ data.
- Using the Services for any unlawful, harmful, or abusive purpose.
9. Ratings & Reputation
Clients and project managers may rate and review your work. These ratings may be used to determine your eligibility for future work and may be visible to clients and Atompod staff. You agree that Atompod may collect, display, and use this feedback to operate the marketplace.
10. Suspension & Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services, with or without notice, if you violate these Terms, provide inaccurate information, fail to complete accepted work, or for any conduct we reasonably believe is harmful to Atompod, clients, or other users. Provisions that by their nature should survive termination will survive.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any particular work, offers, or earnings will result from your use of the Services.
12. Limitation of Liability
To the fullest extent permitted by law, Atompod and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or related to your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amounts paid or payable to you through the Services in the three (3) months preceding the claim, or one hundred U.S. dollars (US$100).
13. Indemnification
You agree to indemnify and hold harmless Atompod and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your performance of (or failure to perform) work, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to arbitration, where applicable.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
